These Terms of Service ("Terms") govern your use of the biohugs mobile application ("App", "Service") provided by Biohugs UG (haftungsbeschränkt), a company registered in Germany ("we", "us", "our", "biohugs").
By downloading, installing, or using Biohugs, you agree to be bound by these Terms. If you do not agree, please do not use the App.
biohugs is a proactive mental wellness application that provides:
biohugs is not a medical device, diagnostic tool, or medical treatment. The app has not been evaluated or approved by any medical regulatory authority for any medical purpose.
The biofeedback data displayed in the App (heart rate, heart rate variability, coherence scores, arousal indicators) is provided for general wellness purposes only and should not be used to diagnose, treat, cure, or prevent any disease or medical condition.
Heart rate and HRV readings from Apple Watch are consumer-grade estimates, not clinical measurements. The wellness scores and classifications the app generates are proprietary indicators, not standardised clinical metrics or medical assessments.
biohugs is not a substitute for professional medical advice, psychological counselling, psychiatric treatment, or any other professional healthcare services. If you have or suspect you have a medical or mental health condition, consult a qualified healthcare professional.
The cognitive reframing scripts (based on evidence-based techniques), meditation guidance, and yoga instructions generated by the AI are educational and supportive in nature. They do not constitute psychotherapy, counselling, or a therapeutic relationship. They are generated by an AI system and are not reviewed by a licensed clinician before delivery.

Some sessions involve breathing exercises and yoga poses. If you have respiratory conditions, cardiovascular conditions, musculoskeletal injuries, or other health concerns, consult your doctor before using these features. Stop any exercise immediately if you feel discomfort, dizziness, pain, or shortness of breath.
Binaural beat sessions require stereo headphones to function as intended. If you have epilepsy, auditory sensitivities, or a history of seizures, consult your physician before using binaural audio features.
You must be at least 18 years of age to create an account and use biohugs. By using the App, you represent and warrant that you are 18 years of age or older.
By accepting these Terms, you represent that you have the legal capacity to enter into this agreement.

You may also use the App in guest mode without creating an account. In guest mode, all data stays on your device and no cloud sync occurs. Functionality may be limited.
You agree to provide accurate, current, and complete information during registration and to keep it updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use.
Each account is personal and non-transferable.
biohugs offers a free tier with core functionality and a Premium subscription with additional features. A Premium subscription is not required to use the core features of biohugs.
All subscriptions are processed through Apple's App Store using StoreKit. By subscribing, you also agree to Apple's Terms and Conditions: https://www.apple.com/legal/internet-services/itunes/
You can manage and cancel subscriptions in:
iPhone Settings > [Your Name] > Subscriptions > biohugs
Cancellation takes effect at the end of the current billing period. You retain Premium access until then.
Subscription prices are displayed in the App and may vary by region. Price changes will not affect your current billing period. You will be notified of price changes before your next renewal.
Refund requests must be directed to Apple at https://reportaproblem.apple.com. We cannot issue refunds directly as Apple processes all payments.
Session scripts, breathing introductions, cognitive reframing prompts, and yoga instructions are generated by an AI system. The AI uses your first name, mood, energy level, and biofeedback context to personalise content.
When you are offline, the app uses pre-written fallback scripts. AI personalisation requires an internet connection.
We reserve the right to modify, update, or discontinue AI-generated features at any time, including changing the underlying AI provider.
You agree NOT to:
The App, including its design, code, branding, audio content, visual assets, algorithms, and AI content systems, is the property of Biohugs UG (haftungsbeschränkt) or its licensors and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.
You retain ownership of your personal data. By using the App, you grant us a limited licence to process your data as described in our Privacy Policy solely for the purpose of providing the Service.
If you provide feedback or suggestions, you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use such feedback to improve the Service, without obligation to you.
Your privacy is fundamental to biohugs. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that using biohugs will achieve any particular wellness outcome, reduce stress, improve focus, or produce any specific health benefit. Individual results vary.
We do not guarantee uninterrupted, error-free, or secure operation of the App. Features depending on third-party services (AI, voice synthesis, HealthKit) are subject to those services' availability.

To the maximum extent permitted by law, Biohugs UG (haftungsbeschränkt) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
Our total aggregate liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty euros (EUR 50), whichever is greater.
We are not liable for failure or delay due to causes beyond our reasonable control, including natural disasters, pandemic, war, governmental action, network failures, or third-party service outages.
To the extent permitted by applicable law, you agree to indemnify Biohugs UG (haftungsbeschränkt) from claims arising from your use of the App in violation of these Terms or applicable law.
This clause does not apply to consumers in the EU/EEA to the extent it would be unfair under Directive 93/13/EEC (Unfair Contract Terms Directive).
You may stop using the App at any time. Delete your account through Settings > Account > Edit Profile > Delete Account. Cancel subscriptions through your Apple ID settings.
We may suspend or terminate your access if:
Upon termination, your licence to use the App is revoked. You may request deletion of your data per our Privacy Policy. Sections 3 (Health Disclaimer), 9 (IP), 11 (Liability), 12 (Indemnification), and 14 (Governing Law) survive termination.
These Terms are governed by the laws of the Federal Republic of Germany, excluding CISG.
For EU consumers: You also benefit from mandatory consumer protection provisions of your country of residence (Regulation (EC) No 593/2008, Art. 6(2)).

We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) and do not currently do so.
For US users: Disputes shall first be attempted through good-faith negotiation for a period of 30 days before either party may initiate legal proceedings.
The following terms apply to your use of biohugs obtained through the Apple App Store. In the event of any conflict between these terms and the rest of these Terms of Service, these terms control with respect to your use of the App on Apple devices.
You and biohugs acknowledge that these Terms are concluded between you and biohugs only, and not with Apple Inc. ("Apple"). biohugs, not Apple, is solely responsible for the App and its content. These Terms do not provide for usage rules for the App that conflict with the Apple Media Services Terms and Conditions as of the date you accept these Terms.
The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
biohugs is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You and biohugs acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
biohugs is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of biohugs.
You and biohugs acknowledge that biohugs, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of the HealthKit framework. These Terms do not limit biohugs' liability to you beyond what is permitted by applicable law.
You and biohugs acknowledge that, in the event of any third party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, biohugs, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third party terms of agreement when using the App (e.g., your wireless data service agreement).
You and biohugs acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.
We may modify these Terms at any time. We will provide notice of material changes by:
For existing subscribers, material changes to subscription-related terms will not take effect until the next renewal period.
If you do not agree, stop using the App before the changes take effect. Continued use constitutes acceptance.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Biohugs UG (haftungsbeschränkt) regarding use of the App.
If any provision is found invalid, the remaining provisions remain in full force. The invalid provision is replaced with a valid one most closely reflecting the original intent.
Failure to enforce any right does not constitute a waiver of that right.
You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
These Terms are available in English and German. In case of discrepancy, the German version prevails.
